Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Lease Reputation LLC (“LeaseReputation,” “we,” “us”). They govern your access to and use of the leasereputation.com website and related services (the “Service”).
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Who can use LeaseReputation
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate information and to keep it current.
What LeaseReputation is — and isn’t
LeaseReputation is a platform that hosts ratings and reviews of apartment communities, contributed by users and, where possible, verified as coming from people who actually lived there. We also provide tools to search communities and read those reviews.
We are not a party to your lease, a landlord, a property manager, a broker, or a real-estate agent, and we do not rent, sell, or manage housing. Reviews reflect the personal opinions and experiences of the individuals who write them. We do not guarantee any apartment community, and we do not guarantee that any review is accurate, complete, or current.
Your account and verification
You are responsible for your account and for keeping your login credentials secure. You are responsible for activity that occurs under your account.
To submit a review, you must complete our verification process and provide truthful verification information. We may approve, deny, suspend, or revoke verification or accounts at our discretion, including where we suspect inaccurate information, manipulation, or abuse.
Your content and reviews
You retain ownership of the content you submit (“User Content”). By submitting User Content, you grant LeaseReputation a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt, and promote that content in connection with operating and marketing the Service.
You represent that your User Content is your own first-hand experience, is truthful and not misleading, does not violate anyone’s rights, and complies with our Community Guidelines. We may moderate, refuse, label, or remove User Content, and we may retain copies of removed content for records, security, and legal purposes.
Prohibited conduct
For everyone
- Posting fake, paid, incentivized, or misleading reviews, or reviews of a property you did not live in.
- Posting another person’s private or identifying information, or content that is harassing, threatening, hateful, discriminatory, defamatory, obscene, or illegal.
- Impersonating any person or entity, or misrepresenting your affiliation with a property.
- Scraping, harvesting, or using bots or automated means to access or collect data, or interfering with the Service’s operation or security.
For property managers, owners, and their agents
If you are associated with an apartment community, you may not write reviews of your own properties; solicit, buy, or offer incentives or perks in exchange for reviews; write reviews of competitors; or attempt to suppress, alter, remove, or retaliate against honest reviews.
Many of these practices — including buying reviews, suppressing negative reviews, and offering incentives in exchange for reviews — are prohibited by the U.S. Federal Trade Commission’s rules on consumer reviews and testimonials, in addition to violating these Terms.
Property managers and businesses
If we offer tools for businesses to claim a listing or respond to reviews, your use of those tools is also subject to these Terms. Regardless of any business relationship, ratings, review visibility, and rankings are determined by us and are not for sale.
Reviews are user content
User Content is created by users, not by LeaseReputation. We do not endorse and are not responsible for User Content, and we act as a platform that hosts third-party content. Consistent with applicable law, including Section 230 of the Communications Decency Act, we are not liable for content provided by others.
Verification reduces the risk of inauthentic reviews but does not eliminate it, and it is not a guarantee of the accuracy of any review.
Intellectual property
The Service, including our software, the LeaseReputation name, the shield logo, and other marks and design elements, is owned by LeaseReputation and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, or create derivative works of the Service except as expressly permitted.
Copyright and takedowns
We respect intellectual-property rights. If you believe content on the Service infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act (DMCA) to legal@leasereputation.com, including identification of the work, the infringing material and its location, your contact information, and the required statements. We may remove infringing material and terminate repeat infringers.
Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT REVIEWS ARE ACCURATE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LEASEREPUTATION AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Indemnification
You agree to indemnify and hold harmless LeaseReputation and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for violations of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
Governing law and dispute resolution
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at legal@leasereputation.com and try to resolve the dispute informally for at least 30 days.
Except where prohibited by law, you and LeaseReputation agree to resolve disputes through final and binding individual arbitration, and you and LeaseReputation waive the right to a jury trial and to participate in a class action. If arbitration does not apply, the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction. Changes to these terms
We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
